Terms of Service

1. The service

VerbalPush lets you change your website by voice or text. We turn your instruction into an edit, read it back to you, and publish it after you confirm. Every change is logged, and you can undo it. We also host your site and can rebuild an existing site for you.

2. The free site rebuild

Before you commit to anything, we will rebuild your site at no charge and show it to you. You may keep the new site, or keep your current site. Either site can use this service. A free rebuild creates no obligation. We may decline a rebuild if we cannot reasonably do it, for example because a site depends on features we do not support.

3. Your authority and your account

You confirm that you own your website and content or have permission to change it, and that you are old enough to enter a contract.

Instructions sent from your approved phone, number, email or login are treated as coming from you. You are responsible for keeping your access private and for telling us right away if it is lost or misused.

4. Your content and ownership

You own your website, text, photos and other content ("Your Content"). You give us permission to host, copy, process and display it as needed to provide the service.

Your site is kept in a repository that you can own. You may leave at any time and take everything: your site files and their history. We keep ownership of our own software, tools, and know-how.

5. AI and your approval

We use AI to understand your instructions. AI can make mistakes. That is why we read each change back and wait for your confirmation before publishing, and why you can undo any change. You are responsible for reviewing what you approve.

You are also responsible for what your site says, including prices, availability, listings, offers and claims, and for following the laws and rules that apply to your business (for example real estate advertising, fair housing, consumer protection and licensing rules). We do not give legal, financial or compliance advice.

6. Unlimited changes and fair use

"Unlimited" means we do not charge per change. Your plan covers as many edits to your own website as you reasonably need for running your business.

Fair use means ordinary business use. It does not cover reselling the service, running automated or bulk requests, or using one plan for many unrelated businesses. Large new builds, such as a full redesign, e-commerce, customer logins, a database or new AI features, are quoted separately. If your use is far above normal and affects other customers, we will talk with you first, and then we may adjust your plan or limit use.

7. Acceptable use

You agree not to use the service to break the law, mislead or harm people, infringe anyone's rights, publish discriminatory, fraudulent or deceptive content, spread malware, or interfere with the service or others' use of it. We may remove content or suspend service for a violation.

8. Fees and billing

Fees are shown on our website or in your quote. After any free trial or rebuild, the plan is billed monthly in advance until you cancel. Prices exclude taxes, which we add where required. We will give you at least 30 days' notice before a price change takes effect.

Launch price. If you sign up for the paid plan on or before December 31, 2026, the plan is $99 a month for 12 months in a row. After those 12 months the plan is $149 a month. If you cancel, or your service stops for non-payment, the launch price ends, and if you return later the plan is $149 a month. The move from the launch price to $149 is part of this offer and does not need separate notice.

You keep paying for your own domain name and any outside services you choose. We may suspend service for unpaid fees after notice.

9. Cancelling and leaving

You may cancel at any time. Cancellation takes effect at the end of the billing period you have paid for, and we do not give partial-month refunds. On request we will give you a complete copy of your site and its history, and help you move it. After you cancel, we may stop hosting your site unless we have agreed otherwise.

10. Third-party services

The service relies on outside providers, such as hosting, code repositories, domain registrars, AI providers and payment processors. Their terms apply to their services, and we are not responsible for their outages or actions.

11. Availability

We aim to make VerbalPush available every hour of every day, but we do not promise uninterrupted or error-free service. We may perform maintenance, and outside providers can have problems we do not control. "Instant" and "in minutes" describe typical results, not a guarantee of timing.

12. Disclaimers

The service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost sales, lost data or lost goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose, or $100 if you have not paid anything. Some places do not allow these limits, so they may not fully apply to you.

14. Indemnity

You agree to defend and reimburse us for claims, damages and costs arising from Your Content, your instructions or your violation of these terms or the law.

15. Ending the service

We may suspend or end your access if you break these terms or if we stop offering the service. If we end the service without cause, we will give you notice and a copy of your site.

16. Governing law and disputes

These terms are governed by California law, without regard to conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Los Angeles County, California, and you agree to their jurisdiction. Before filing a claim, each of us agrees to try to resolve it informally by contacting the other for at least 30 days.

17. Changes to these terms

We may update these terms. We will post the new version here with a new effective date, and for material changes we will notify customers. If you keep using the service after a change takes effect, you accept the new terms.
